The brain-child and what some call the biggest victory for President Barack Obama may have hit a major road block as a federal appeals court ruled components of the healthcare plan unconstitutional.
The ruling states that “Congress does not have the power to require all Americans to buy health insurance.” In the 2 – 1 decision, Atlanta judges labeled the mandate as “unprecedented” and unlike any commercial regulation upheld in our county’s past.
Utah Senator Orrin Hatch praised the court appeal, stating, “Today’s ruling is a victory for both personal liberty and the U.S. Constitution.”
Along with Utah, 25 other states filed the lawsuit against Obamacare, including 44 members of the U.S. Senate.
The lawsuit now sets the stage for a Supreme Court ruling within the next year that could determine the fate of the healthcare reform law.
